Terms of Service

MedElevate LLC, DBA MedElevate Insurance

Florida Insurance Agency License No. L138486

Last updated: October 10, 2026

1. Welcome and Agreement

These Terms of Service ("Terms") govern your use of the MedElevate Insurance website and related online educational resources, forms, event registrations, and appointment tools (collectively, the "Site"). The Site is operated by MedElevate LLC, DBA MedElevate Insurance ("MedElevate," "we," or "us"), a Florida insurance agency. By using the Site, you agree to these Terms as they apply to the Site. You may still contact us through another channel if you do not wish to use online forms.

These Terms are intended to be fair and understandable. Nothing in them waives rights you have under Medicare, insurance, privacy, consumer-protection, or other applicable law.

2. What We Do

MedElevate provides general Medicare education, information about insurance options and healthy aging, and access to licensed insurance assistance. Depending on eligibility, appointments, and applicable authorizations, we may assist with Medicare Advantage, Medicare prescription drug coverage (Part D), Medicare Supplement insurance (Medigap), and other insurance products for which we are properly licensed and appointed.

MedElevate is an independent insurance agency, not Medicare, the Centers for Medicare & Medicaid Services (CMS), a government office, or an insurance carrier. We are not connected with or endorsed by the United States government or the federal Medicare program. Private insurers issue the actual insurance policies and determine benefits under their filed plan documents and applicable law.

3. Educational Content; No Guarantee of Coverage

Website articles, eligibility summaries, event notices, examples, plan explanations, and healthy-aging information are educational. They may not reflect every individual circumstance, service area, policy limitation, plan change, or enrollment deadline. We work to keep material accurate but cannot promise that all website content is complete or current at every moment.

Information on the Site is not individualized medical advice, a diagnosis, legal advice, tax advice, investment advice, or financial planning advice. Do not delay or change treatment based on website information; consult your licensed health care professional as needed. Individual insurance recommendations, when provided, are handled through an appropriate licensed and compliant process, not automatically by visiting a webpage. Educational calculators, examples, and checklists do not determine carrier eligibility or replace actual plan documents.

4. Medicare Plan Availability and Important Notices

We do not offer every Medicare plan available in every service area. The plans we can discuss or help enroll may depend on county, residence, eligibility, current carrier contracts, plan year, and the type of coverage. Our Medicare TPMO disclaimer, including the number of organizations and products represented where required, is displayed separately and prominently on applicable website pages and other communications. You can research all Medicare options at Medicare.gov (opens in a new tab) or by calling 1-800-MEDICARE (1-800-633-4227).

We may receive commissions or other permitted compensation from insurers if a policy is purchased or renewed. We do not charge Medicare beneficiaries a marketing consulting fee for considering enrollment in a Medicare Advantage plan. The availability of compensation does not change a beneficiary's right to select a plan that meets their needs. Quotes, premiums, plan descriptions, eligibility, provider networks, formularies, underwriting, exclusions, waiting periods, and effective dates are subject to the insurer's current rules and the official policy or plan materials; a website estimate is not a promise of coverage or payment of a claim.

5. No Enrollment or Scope of Appointment from Browsing

Viewing the Site, completing a contact form, requesting a callback, registering for an event, or scheduling an appointment does not enroll you in any insurance plan, guarantee acceptance or effective dates, authorize us to change existing coverage, or constitute a Scope of Appointment (SOA). A covered Medicare marketing appointment may require a separate SOA and other required disclosures. A final insurance application, plan enrollment, consent to enrollment, and carrier approval must occur through the applicable authorized process.

You may ask questions, decline a plan recommendation, or stop an enrollment discussion without being required to purchase anything.

6. Forms, Accuracy, and Sensitive Information

Please submit information that is accurate to the best of your knowledge, including correct contact details and any permission to act for another person. Do not impersonate another person or submit a beneficiary's information without permission or lawful authority. Inform us when information necessary for an application is incorrect or changes. You must not submit fraudulent documents, malicious code, or information that violates another person's rights.

Do not enter Social Security numbers, Medicare numbers, banking credentials, detailed medical records, or other highly sensitive information in general public forms, ordinary email, or SMS. We will provide or direct you to a secure workflow when necessary. Our Privacy Policy explains how we handle information you choose to provide.

7. Calls, Scheduling, and Communications

If you ask us to contact you, schedule a telephone appointment, or submit an event Permission to Contact form, we may respond to that specific request and related service needs in a lawful manner. An inquiry, event sign-in, or phone-call permission is not blanket approval for unrelated marketing or text messages; it does not enroll you in any plan or replace a required Scope of Appointment.

MedElevate uses a compliant telephone recording service. We provide required recording notices and obtain consent required under applicable law, including Florida's all-party-consent rule for private calls. Covered Medicare Advantage and Part D marketing and sales telephone calls are recorded and retained under the current CMS requirements. If you decline recording, we will discuss whether an alternative compliant option is available.

Our SMS/text messaging program is not yet operating as of the date of these Terms. When it becomes available, we will send texts only to people who have provided prior, separately documented written consent for the relevant category. Consent may be given through an unchecked website checkbox with an electronic acknowledgment or through a signed event Permission to Contact form with an express SMS selection. We will use separate choices for appointment/service texts and promotional/marketing texts. You may decline either option without affecting your ability to request assistance or enroll through a lawful process.

If you later opt in, text frequency may vary, message and data rates may apply, and you may opt out by replying STOP, by any other reasonable method, or by contacting privacy@medelevatehealth.com. HELP will be available for assistance after the program launches. Consent for automated marketing outreach, if used, will meet any additional applicable disclosure and consent requirements. Our Privacy Policy describes additional communications and consent safeguards.

8. Electronic Records, Signatures, and Notices

We may offer appointment confirmations, forms, applications, and other records electronically through email or secure third-party tools where lawful. Using the website or sending an inquiry does not, by itself, mean you agree to receive legally required disclosures only in electronic form. When federal or state law requires separate consent to electronic records or signatures, we will provide the required notices and obtain that consent through the appropriate process. Where applicable, you may request paper records or withdraw electronic-delivery consent according to the disclosure provided for the particular transaction. A Scope of Appointment, an insurance application, and any carrier-required signature remain separate from these website Terms.

9. Third-Party Platforms, Quotes, and Service Providers

To schedule appointments, operate the site, manage secure documents, preserve permissions, or assist with insurance service, we may use software and vendors such as customer relationship management platforms, scheduling services, electronic-signature tools, telephone and recording services, secure file systems, and carrier quoting or enrollment portals. Independent insurers and platforms may have separate terms and privacy notices. We remain responsible for our own legal duties; these Terms do not transfer those duties to a beneficiary or excuse conduct for which MedElevate is responsible under applicable law. Insurers—not MedElevate—make the final decisions on underwriting, policy issuance, premiums, claims, and coverage according to law and their policy terms.

10. Events and Educational Sessions

Events may be educational or marketing-related; event descriptions will distinguish these where required. Providing contact information is not a prerequisite for attending an open Medicare marketing event when prohibited by CMS rules, and attending an educational session does not require you to speak with an agent or submit an application. Information presented at an event is subject to applicable plan rules and the event's stated purpose.

11. Website Access and Appropriate Use

You may read, print, or save Site materials for your own lawful, personal, noncommercial use, with proper attribution and without altering them in a misleading way. Please do not attempt unauthorized access, interfere with site security, submit malicious code, scrape personal information, impersonate someone else, or republish our copyrighted materials for commercial use without permission. These restrictions do not limit rights you have under applicable law.

12. Optional Website Accounts

If we introduce a password-protected account or provide access through a secure portal, please safeguard the credentials issued to you and notify us promptly of suspected unauthorized use. Do not access another person's account without authorization. MedElevate may restrict access to a website feature when reasonably needed to address misuse or a security risk; doing so does not cancel an insurance policy, remove lawful appeal rights, or prevent you from contacting your insurer or requesting alternate assistance.

13. Copyright and Third-Party Materials

Unless otherwise noted, Site copy, designs, logos, and original educational materials are owned by MedElevate or licensed to it. Medicare program names, insurer trademarks, and linked third-party content remain the property of their respective owners. Links to public or private third-party websites are offered as a convenience, not a promise of endorsement, availability, accuracy, or security.

You retain ownership of documents or personal information you submit. Submission gives us only the permission reasonably necessary to process your request and comply with legal duties; it does not transfer ownership of your information or permit unrelated commercial use.

14. Feedback, Stories, and Testimonials

You may send corrections, ideas, or general feedback to help us improve our services. Providing feedback does not transfer ownership of your health information, medical records, or other personal data to MedElevate. We will not post an identifiable testimonial, publish private insurance details, or use your likeness for promotion merely because you sent us a suggestion; separate permission will be requested when appropriate. We may use nonsensitive general suggestions to improve the website, consistent with our Privacy Policy.

15. Privacy and Security

Our Privacy Policy describes information collection, permitted disclosures, call recordings, security, retention, and your choices. Where a law requires a separate consent or privacy notice, these Terms do not replace it. Please report suspected security problems or privacy concerns to privacy@medelevatehealth.com. No publicly accessible website can guarantee uninterrupted or completely secure service.

16. Accessibility and Assistance

We aim to provide readable information and reasonable assistance to people who have difficulty using online forms or accessing website content. If you need help, an alternate format, or a different way to contact us, email privacy@medelevatehealth.com with your preferred callback contact details. Do not include sensitive medical or Medicare identifiers in the email.

17. Website Availability; Reasonable Limits

The Site and educational content are provided for general information on an "as available" basis. Temporary errors, outages, outdated links, or typographical mistakes may occur. To the extent permitted by law, MedElevate is not responsible for ordinary technical interruption or reliance on general website content without verification of current plan terms. This provision does not excuse fraud, intentional misconduct, negligence where liability cannot lawfully be excluded, failure to protect information as required by law, or other nonwaivable statutory duties. It does not limit rights or remedies provided by Medicare or Florida consumer-protection laws.

18. Complaints and Disagreements

If you have a concern about Site information, communications, privacy, or our service, contact privacy@medelevatehealth.com so we may try to resolve it. You may also contact the relevant insurance carrier or applicable federal or state regulator. Nothing in these Terms prevents you from filing a regulatory complaint or exercising lawful appeal rights.

These Terms do not require mandatory arbitration, waive class-action rights, or restrict your ability to use courts where authorized by law. Florida law generally governs interpretation of these Site Terms, except where federal law or another applicable law controls; any court venue is determined by law, not by a waiver imposed in these Terms.

19. Updates to These Terms

We may revise these Terms as services or laws change. The current version and effective date will be posted on the Site. Material revisions will be accompanied by notice when legally required. Updated Terms will not retroactively constitute an insurance application, new marketing consent, or a waiver of rights.
